AtmoSphere Analytics LLC Terms of Service

Welcome to AtmoSphere Analytics LLC ("AtmoSphere", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website, including any content, functionality, and services offered on or through our website (collectively referred to as the "Services").

Please read these Terms carefully before you start to use our Services. By using our Services, you accept and agree to be bound and abide by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or the Privacy Policy, you must not access or use our Services.

1. Scope of Services

Our Services include weather modeling services. We reserve the right to withdraw or amend our Services, and any service or material we provide on the Services, in our sole discretion without notice.

2. Use of Services

The Services are intended for personal use. If you wish to use our Services for commercial purposes, you must obtain a commercial license from us. To apply for a commercial license, please contact us at support@mesoscaleforecast.com.

3. Accuracy of Models

While we strive for accuracy in our weather modeling services, we do not guarantee the accuracy of any model forecast. You agree that you use the model forecasts at your own risk and that we will not be liable for any inaccuracies.

STORM-Net's accuracy is not guaranteed. STORM-Net is not a replacement, alternative for, or competition to National Weather Service alerts, advisories, watches, or warnings. Our models, specifically STORM-Net, are not competing with NWS, and are NOT an alternative to NWS warnings.

4. Refund Policy

We do not offer refunds on the basis of model forecast inaccuracy. All purchases of our premium services are final and non-refundable, unless otherwise specified in a written agreement between you and us.

5. Premium Subscriptions

When you cancel your premium subscription or if your premium subscription is terminated by us, your access to premium services will be immediately revoked.

We reserve the right to cancel or suspend your premium subscription for any reason, at any time, in our sole discretion.

6. Access Termination

We reserve the right to ban or restrict any user from accessing our Services for any reason and at any time, in our sole discretion.

7. Intellectual Property Rights

The Services and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by AtmoSphere, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Premium products provided through our Services are the property of AtmoSphere and must not be shared, distributed, or reproduced without our explicit permission.

8. Model Run Request and Guarantees

Model run requests are considered as requests and are not guaranteed. The fulfillment of a model run request is subject to system capacity and other considerations at our discretion. In the event that a model run request is denied for any reason, including but not limited to system capacity issues, the credits corresponding to the request will be refunded to your account. This refund process will be automatic and no further action is required on your part to initiate the refund. AtmoSphere reserves the right to deny any model run request at its sole discretion.

8. Changes to the Terms of Service

We may revise and update these Terms of Service from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Services thereafter. Your continued use of the Services following the posting of revised Terms of Service means that you accept and agree to the changes.
